Public health and constitutional law have evolved to better protect both health and human rights. States’ sovereign power to make laws of all kinds has not changed in the past century. What has changed is the Court’s recognition of the importance of individual liberty and how it limits that power. Preserving the public’s health in the 21st century requires preserving respect for personal liberty.

The Copenhagen Accord
The Copenhagen Accord is a document which delegates at the 15th session of the Conference of Parties (COP 15) to the United Nations Framework Convention on Climate Change agreed to “take note of” at the final plenary on 18 December 2009.[1][2]

I want to be clear – we are not tied, and the outcome of Copenhagen is not tied, to the timeline on any single piece of domestic U.S. legislation. Jacobson argued that the smallpox vaccination law not only infringed on his religious liberty but also was arbitrary and capricious. The Court disagreed, writing that Jacobson’s individual right must give way to the “common good.”

The Court emphasized that government officials were acting out of necessity as smallpox was “prevalent and increasing at Cambridge.” This emergency situation justified the government official’s action in making the smallpox vaccination mandatory.
